Town Council Holds Special Call Meeting on ARDA and Captain Sam’s Spit

On Wednesday, March 27, Town Council convened for a Special Call Meeting.  No decisions were made in executive session.

During open session, the Town Council expressed concerns regarding the substance and language of the proposed deed to convey the low-lying lands of Captain Sam’s Spit from Kiawah Development Partners (KDP) to Kiawah Island Community Association (KICA).  The Council also expressed concerns about the process that has been followed in negotiating the deed, noting that pursuant to the ARDA both the Kiawah Conservancy and the Town are interested parties to the conveyance and required easements and deed restrictions.

Moving forward, the Town Council stated that the appropriate course of action is for KICA, the Kiawah Conservancy, and the Town to collaborate with regard to any discussions with KDP regarding the terms of the conveyance of the low-lying lands, the restrictive covenants on the highlands, and the conservation easement in favor of the Conservancy.
