Notice of Intent to Demolish 122 Turnberry Drive
On August 7, Town Council authorized the Town Attorney to proceed with the legal action to file to demolish the property located at 122 Turnberry.
The Town has made repeated efforts to contact the owner and mortgage holder with no avail. On January 16, 2018, The Town filed a Summons and Complaint along with a Notice of Condemnation but received no response. In March of this year, the Town filed an amended condemnation notice with Charleston County, allowing the Town to enter and inspect the property. That inspection revealed other structural, health, sanitation, and zoning regulations necessitating eventual demolition of the structure.
The next step in the process is to publish the Notice of Condemnation in the Post and Courier prior to a hearing for Summary Judgment. After the notice runs for the three weeks’ notice period, the court will hold a final ruling on the case before demolition can occur.
The Town is operating under the South Carolina’s Eminent Domain Procedure Act. Following the final court ruling, the Town will pay for demolition and minimal landscaping and then place a lien against the property but will not acquire the property. The Town estimates that it will cost $50K-$60K for demolition and landscaping.
